Licence Terms & Conditions

  1. Your right to use the software, as distributed by Pookanyoni, is subject to the terms and conditions set out in this software license agreement.
  2. Whilst it is the intention of Pookanyoni to make the software available to the widest possible audience, the possession and / or the source of the software has no entitlement to use or distribute the software and does not form any part of the software license agreement. The installation of the software onto any electronic device, whether portable or fixed to an electrical supply, or using any part of the software and / or electronic or printed material that may accompany the software, signifies acceptance to the terms and conditions set out within this software license agreement.
  3. Headings:
    used within this Software License Agreement are for convenience only and shall not affect its construction or interpretation of the contents of this Software License Agreement.
  4. Using the software:
    means to load, store, transmit or display the software onto or from any electronic device, whether portable or fixed to an electrical supply for any purpose what so ever.
  5. License:
    to use the software grants a non-exclusive and non-assignable right to use the software for which payment to Pookanyoni has occurred in accordance with the relevant license fee. The process of licensing the software requires the insertion into the software, at the interface elected by Pookanyoni for this purpose, the payment receipt number issued by Pookanyoni or its appointed agent on receipt of payment. The retention of this payment receipt number is the burden of the payee of the licence and the loss will not result in replacement at the cost of Pookanyoni. On completion of the additional information requested within this interface, the software will require internet access. The software will forward to Pookanyoni, the additional information, including the payment receipt number and will receive from Pookanyoni or its appointed agent, the activation key which will grant use of the software on a single electronic device.
  6. Additional Information:
    may include, but is not limited to:-
    1. Licensee (This information will accompany all instances of Import and / or Export performed from the software to another installation of Pookanyoni software and will be displayed on the login screen each time the software is accessed. This information will be retained by Pookanyoni, not for distribution or any other purpose)
    2. Street Name & Number - (This information will be retained by Pookanyoni, not for distribution or any other purpose).
    3. Town or City - (This information will be retained by Pookanyoni, not for distribution or any other purpose)
    4. e-Mail Address - (This information will be retained by Pookanyoni, not for distribution or any other purpose).
    5. Serial Number - (Receipt number issued on payment. The serial number must be stored in a safe place as the activation key will be withheld until it has been entered into the designated location. Access to Pookanyoni provided interactions on the internet will be conditional to the entry of this serial number. The use of this serial number on more than one installation shall be considered a breach of this license agreement.).

  7. Export and Import of Data:
    employs the Licensee name, as a method of identification of the original source of the data and the associated files accompanying the data and no provision exists within the license to alter any of those details.
  8. Software License Agreement Termination:
    does not exist. Refunds from software licence agreement terminations does not exist and no claim for refund, in part or whole, will be considered.?á The 14 day free trial period is considered adequate to test all elements of the software.
  9. Warranties:
    are that the software, when used in accordance with the instructions, will provide the functions and uses for which Pookanyoni has designed into the software. Where applicable, updates, upgrades, patches and fixes, but excludes new versions, will be made available for installation, free of charge on the internet, and the method of installation will be prescribed. These warranties are in lieu of all other warranties, representations or conditions, express or implied, statutory or otherwise, including any implied warranties of satisfactory quality and fitness for a particular purpose or that the Product will meet individual requirements, or that the operation of it will be uninterrupted or error free or make any representation regarding the use of the Product or the results of such use in terms of correctness, accuracy, reliability or otherwise. No oral or written communications by Pookanyoni or it's agents on behalf of Pookanyoni shall create a warranty or in any way increase the scope of the warranties given. Pookanyoni's entire liability and exclusive remedy under the warranties given in this clause will be at Pookanyoni's option either to:
    1. repair or replace the software which does not conform with the warranty; or
    2. refund the price paid for the Product and terminate the License.
  10. Disclaimer and Limitation of Liability:
    exists in that the software has been designed for the widest possible application by the widest possible audience and that Pookanyoni has no control, direct or inferred, over it's use and application. The limitation of liability is there set to a maximum of the value paid for the software licence and that Pookanyoni accepts no liability for any indirect, consequential, incidental or special damage, or loss of any kind (including loss of profits, business, chargeable time, anticipated savings, goodwill, any business disruption or loss of or corruption of data), however caused and whether arising under contract, tort, including negligence, statute or otherwise. Should a court of competent jurisdiction hold invalid, for any reason, this document or any part thereof, Pookanyoni shall not become liable for loss or damage that the court considers a liability of Pookanyoni, an amount greater than the software licence fee paid which secured the payment receipt number referred in item 5. Pookanyoni, by it's very nature of distribution and marketing, may become infected by a virus/s, become susceptible to third party interference and / or embedded code or be incomplete due to the process in which the software was installed onto the medium supporting the software although distributed free of such impediments by Pookanyoni. Pookanyoni accepts no liability for third party interference and / or embedded code or for being incomplete due to the process in which the software was installed onto the medium supporting the software or the effects and / or results of this eventuality.
  11. Copyright & Intellectual Property:
    exists in this software and is the sole property of Pookanyoni Limited and is protected by copyright laws and international treaties. To load, store, transmit or display the software onto or from any electronic device, whether portable or fixed to an electrical supply for any purpose what so ever is to recognise and accept that both the copyright and intellectual property connected to the software is the sole property of Pookanyoni Limited and that it's uses are limited to the terms and conditions specified with this software licence agreement.
  12. Trademarks
    Pookanyoni and Goggaki, are registered trademarks and rights are reserved worldwide. All other product names mentioned herein are the property of their respective owners.
  13. Jurisdiction:
    of the control, development and distribution of this software is resident in the Isle of Man where the incorporation of Pookanyoni exists. This software licence shall be governed by and construed exclusively in accordance with the laws of the Isle of Man.
